WORKPLACE HARASSMENT INVESTIGATIONS: NEW RULES
 
Once any supervisor is made aware of a complaint of harassment, employers must immediately commence a thorough and objective investigation. It must then promptly and effectively remedy any harassment revealed by the investigation.
 
Typically, this culminates with one of two results: 1) the termination of the harasser, or 2) a finding that the complaint was unsupported by the evidence.
 
Because of the intense emotions that are typically activated by such complaints, either result will likely be presented to a plaintiffs’ lawyer to determine if there is a sound legal basis for a lawsuit.
 
This will place the employer’s investigation, and whether it was conducted in accordance with applicable legal requirements, under a microscope. If mistakes were made, it is likely that a lawsuit will result.

This ongoing seminar series is being conducted by veteran Petaluma labor & employment attorney, Jay Putnam. Putnam, has advised employers exclusively, in labor matters for over 35 years. He hopes to provide local business owners and managers with a solid, working understanding of California labor law, as a means of helping them avoid the often crippling cost and disruption caused by lawsuits resulting from a misunderstanding of applicable legal requirements.

Members are encouraged to bring their questions.  Putnam says he intends to conduct the seminars as "informal, working sessions, where people can bring their lunch and their questions and leave each month with important information that will immediately improve their business operations.
