Work Place Injuries/What you don’t know, can kill you
When employees are hurt on the job, employers immediately set about complying with their legal obligations under the Worker’s Compensation Act.
The problem is, that, in the process of doing this, many employers ignore far more dangerous laws that impose different, and sometimes, inconsistent legal obligations arising from the same injury.
These are found in California’s Fair Employment and Housing Act, which treats many employees who are injured on the job as “disabled.” Employers have detailed obligations to provide “reasonable accommodations” that would enable injured workers to perform the “essential functions of the job.” The failure to comply with these allows injured workers to sue employers for discrimination, entitling them to a jury trial with the potential of an award for punitive emotional distress damages and attorneys’ fees.
