HIRING AND FIRING: WHERE THE RUBBER MEETS THE ROAD
To the degree employers avoid making common mistakes at the time of hire, they will eliminate many of the most common grounds for subsequent lawsuits.
This is because if the hiring process is properly conducted, employees will be bound by numerous employment policies that will provide potent legal protection from lawsuits resulting from later workplace disputes or in the event that employees are eventually fired.
Foremost among these are the employment application, mandatory arbitration policy and employee handbook, among several others.
However, such documents will provide legal protection only to the degree that they are properly drafted, and are updated as needed. It is of critical importance that all employer generated documents are scrupulously consistent with each other.
The moral: “An ounce of prevention is worth a pound of cure.”
This ongoing seminar series is being conducted by veteran Petaluma labor & employment attorney, Jay Putnam. Putnam, has advised employers exclusively, in labor matters for over 36 years. He hopes to provide local business owners and managers with a solid, working understanding of California labor law, as a means of helping them avoid the often crippling cost and disruption caused by lawsuits resulting from a misunderstanding of applicable legal requirements.
Members are encouraged to bring their questions. Putnam says he intends to conduct the seminars as "informal, working sessions, where people can bring their lunch and their questions and leave each month with important information that will immediately improve their business operations.
